Welcome to Gidge Water Cartage. By accessing our website or booking our bulk water delivery services, you agree to comply with and be bound by the following terms and conditions. Please read them carefully.

1. Services Provided

Gidge Water Cartage provides bulk water delivery and cartage services within Gidgegannup and surrounding Western Australian regions. All services are subject to water availability, vehicle capacity, and safe site access.

2. Bookings and Cancellations

  • Booking Confirmations: Bookings are confirmed once we have verified delivery details, scheduling availability, and payment terms.

  • Cancellations: If you need to cancel or reschedule a delivery, please provide at least 24 hours' notice. Cancellations made with less than 24 hours' notice may incur a cancellation fee.

3. Pricing and Payment

  • Quotes: Prices quoted are based on the volume of water requested and the delivery location. Quotes are valid for 30 days unless specified otherwise.

  • Payment Methods: We accept payment via Cash, Bank Transfer, and EFTPOS.

  • Payment Terms: Payment must be settled prior to or upon delivery unless a commercial credit account has been pre-approved by us. For bank transfers, funds must clear or a remittance advice must be provided prior to water discharge.

  • Overdue Accounts: We reserve the right to suspend future deliveries if any outstanding invoices remain unpaid past their due date.

4. Property Access and Delivery Conditions

  • Safe Access: It is the customer's responsibility to ensure that our delivery vehicles have safe, clear, and legal access to the property and the water storage tank. This includes ensuring driveways can support heavy vehicles and clear overhead clearance from trees or power lines.

  • Liability for Property Access: Gidge Water Cartage accepts no liability for damage caused to driveways, roadways, underground pipes, overhead structures, or property gates if we are directed onto the property by the customer or if access conditions are inadequate.

  • Tank Condition: The customer is responsible for ensuring their receiving water tank, fittings, and infrastructure are clean, structurally sound, and capable of holding the ordered volume of water. We accept no responsibility for water loss or contamination resulting from faulty customer infrastructure.

5. Water Quality

We source our water from regulated authorities to ensure it meets standard quality requirements at the time of loading. Once the water enters the customer's tank, pipework, or storage facility, the responsibility for maintaining water hygiene and quality transfers entirely to the customer.

6. Limitation of Liability

To the maximum extent permitted by Australian Consumer Law, Gidge Water Cartage shall not be liable for any indirect, incidental, or consequential damages arising out of the use of our website or delivery services. Our total liability for any claim shall not exceed the amount paid by you for the specific delivery in question.

7. Changes to Terms

We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted directly to this page and will take effect immediately upon publication.

8. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Western Australia. Any disputes relating to these terms shall be subject to the exclusive jurisdiction of the courts of Western Australia.

10. Emergency and Fire Support Disclaimer

Gidge Water Cartage provides bulk water delivery for property defence, fire mitigation, and post-fire tank replenishment. If you request our services for fire support, the following conditions strictly apply:

  • Not an Emergency Service: Gidge Water Cartage is a private commercial water carrier. We are not a registered emergency response agency or fire brigade. In the event of an active bushfire emergency, your first priority must always be to contact 000 and follow Department of Fire and Emergency Services (DFES) directives.

  • Driver and Vehicle Safety: The safety of our drivers and vehicles is paramount. We reserve the absolute right to refuse delivery, abort a delivery in progress, or leave a property immediately if our driver deems the environment unsafe due to fire, smoke, high winds, or changing weather conditions.

  • Access Restrictions: We cannot bypass road closures, emergency roadblocks, or police checkpoints. Delivery is strictly contingent on authorities granting safe access to your property.

  • Limitation of Liability: Gidge Water Cartage accepts no liability for any property damage, loss of assets, livestock loss, or personal injury resulting from delayed deliveries, cancelled bookings, or an inability to access a property during a fire event or emergency situation.

11. Safety and Insurance

  • Business Insurance Coverage: Gidge Water Cartage maintains current Public Liability Insurance and Comprehensive Commercial Vehicle Insurance relevant to bulk water cartage and transport services.

  • Site Safety Compliance: Our operators adhere to strict Work Health and Safety (WHS) standards. We reserve the right to refuse service or halt water discharge immediately if site conditions present an active hazard to our staff, vehicles, or the public.

  • Customer Responsibility: The customer must notify us prior to arrival of any known hazards on the property, including concealed underground pipes, low-hanging wires, unstable terrain, or aggressive livestock. Gidge Water Cartage accepts no liability for incidents arising from failure to disclose site hazards.
